General Terms & Con­ditions

I. Preamble

Swiss Grison Sports AG, Zizers, manufactures skis under the ANAVON brand in its workshop. Customers can order and purchase ANAVON's products directly from the workshop or via the website anavon-ski.com. Customers can also build their own skis under expert guidance in ski workshops.

II. Conclusion of the Purchase Contract between ANAVON and the Buyer

1. ANAVON sells buyers the products they have selected, in the workshop or via the website anavon-ski.com, under the delivery and sales conditions set out below.
2. The purchase contract regarding the selected products is concluded upon the complete entry of the order details and the submission of the order in the workshop, by email or via the configurator on anavon-ski.com.
3. Prices are stated in Swiss francs (CHF).

III. Performance of the Purchase Contract

1. Payment is made in advance or, by special agreement, against invoice within 10 days net.
2. The delivered products remain the property of ANAVON until payment is made in full. ANAVON is entitled at any time to have an entry made in the retention-of-title register.
3. The products can be collected from the workshop. The products can also be delivered to an address designated by the buyer. In the latter case, the buyer bears the costs of delivery including customs clearance and turnover tax in the event of export, as well as the risk of the products being damaged, destroyed or lost during delivery.
4. As a rule, the ordered products are completed and made available for collection within around 3 to 4 weeks. If delivery is made to an address designated by the buyer, the delivery time also depends in particular on the chosen delivery method and place of delivery. Any claim for damages against ANAVON due to late delivery is expressly excluded.

IV. Warranty and Optional Warranty Extension

1. The warranty period is 24 months from delivery to the buyer. The warranty covers all material and production defects. Identified defects must be reported in writing or by email immediately after collection or delivery, or — in the case of defects appearing later — immediately upon their discovery, but no later than within 5 working days.
2. The warranty rights lapse if unauthorised changes or repairs are made to the products. Improper handling likewise results in the lapse of the warranty. The warranty lapses in the event of payment arrears.
3. Defects are remedied by ANAVON free of charge within the scope of the warranty, by repair or — at ANAVON's discretion — by replacement. Further unilateral claims by the buyer (rescission of contract, damages, price reduction and cancellation) are excluded.
4. Buyers can purchase a warranty extension against ski breakage. During the warranty period of 3 years from delivery to the buyer, the ski will be replaced free of charge in the event of breakage, provided the breakage was not caused by improper handling.
5. Liability for damage to persons or property caused by the use of the delivered products is excluded to the extent permitted by law.

V. Workshop

1. The skis produced during the workshop become the property of the participant upon payment of the workshop.
2. The same warranty rights apply to skis produced during a workshop as set out in Section IV above.
3. During the workshop, ANAVON's machines and equipment are operated. Participants must strictly follow the instructions for the safe operation of the equipment. The skis may also be tested with the participants. It is the participants' responsibility to ensure that they have private accident insurance for these activities. Any liability of ANAVON for personal injury or property damage is excluded to the extent permitted by law.

VI. Data

1. The personal data collected during an order process is processed by ANAVON for the performance of the contract and the handling of enquiries. This data is collected, processed and used exclusively within the framework of the applicable data protection laws.
2. In addition, ANAVON processes and uses the address and order data for advertising purposes. Buyers may object to the use of the data for advertising purposes at any time. The objection may be made in writing or by email.
3. Buyers expressly consent to this use of their personal data.
4. Otherwise, the privacy policy of Swiss Grison Sports AG applies.

VII. Copyright

1. All texts and images on the website anavon-ski.com are protected by copyright. The adoption and use of content from these pages, even in extracts, is prohibited without the written consent of ANAVON.

VIII. Amendments to the T&C

1. ANAVON may amend the T&C periodically, to the extent it considers this necessary.
2. The amendments take effect immediately upon publication on the website anavon-ski.com and apply to all orders placed after publication of the T&C.

IX. Applicable Law, Place of Jurisdiction and Severability Clause

1. Swiss law applies. The exclusive place of jurisdiction for disputes with Swiss Grison Sports AG is Zizers.
2. Should parts of these general terms and conditions be invalid, the validity of the remaining provisions shall not be affected. The applicable statutory provisions shall replace the invalid provisions accordingly.
